These Terms of Service (“Terms”) govern your access to and use of the WeThinkTrades website, products, subscriptions, software, licences, dashboards, and related services (“Services”). By accessing, purchasing, downloading, subscribing to, or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

1. Who We Are

WeThinkTrades is a software company that provides digital trading automation tools, licence-based software access, and related technical services for MetaTrader 5 users. We do not provide brokerage services, investment advice, portfolio management, or financial advisory services.

2. Nature of the Service

Our Services may include:

  • access to digital software products,

  • licence keys or account-linked access,

  • subscription-based use of software,

  • technical support,

  • setup guidance,

  • VPS-related assistance,

  • and related informational materials.

All Services are digital. We do not sell physical goods unless explicitly stated otherwise.

3. Eligibility

By using our Services, you confirm that:

  • you are at least the age of majority in your jurisdiction, or you have permission from a parent or legal guardian;

  • you have the legal capacity to enter into a binding agreement;

  • the information you provide is accurate and complete;

  • and you will comply with these Terms and all applicable laws.

4. Account Registration

To access certain Services, you may need to create an account or submit information such as your name, email address, phone number, WhatsApp number, MT5 account number, or broker details.

You agree to:

  • keep your information accurate and up to date;

  • protect your login details;

  • not share your account with unauthorized persons;

  • and notify us immediately if you suspect unauthorized access.

You are responsible for all activity under your account.

5. Licence and Use

When you subscribe to or purchase our software, you are buying a limited, non-exclusive, non-transferable, revocable licence to use the product for the period you paid for, subject to these Terms.

Unless we expressly permit otherwise:

  • you may not copy, resell, redistribute, lease, sublicense, modify, or reverse engineer our software;

  • you may not share licence keys or access credentials;

  • you may not remove branding, copyright notices, or licence restrictions;

  • and you may not use the software in any unlawful or fraudulent manner.

One licence may be restricted to one account, one user, or one device, depending on the plan selected.

6. Subscription Plans and Billing

Some Services are offered on a subscription basis, such as weekly, monthly, or yearly access. By subscribing, you authorize recurring or one-time charges as displayed at checkout.

You agree that:

  • subscription fees are due in advance;

  • access may be suspended or terminated if payment is not received;

  • prices may change in the future, but changes will not affect a period already paid for;

  • and it is your responsibility to cancel before renewal if you do not wish to continue.

7. Payments

Payments may be processed through third-party payment providers such as Paynow or other supported gateways. By using a payment provider, you also agree to that provider’s terms and conditions.

We do not store full card details or payment credentials unless required by the payment processor and permitted by law.

If a payment is reversed, reversed by the provider, charged back, or found to be fraudulent, we may suspend or terminate your access immediately.

8. Refund Policy

Our digital products and licences are generally non-refundable once the product, licence key, or access details have been delivered by email, dashboard, or other electronic means.

Refunds may only be considered before delivery or activation, in accordance with our Refund Policy.

9. No Financial Advice

WeThinkTrades does not provide financial advice, trading advice, investment advice, or recommendations. Any content on our website, in our emails, in our product descriptions, or in our support messages is for informational and technical purposes only.

You are solely responsible for your own trading decisions, account settings, risk tolerance, capital allocation, and use of our Services.

10. Trading Risk

Trading financial markets involves significant risk. Automated trading, expert advisors, and scalping systems can result in losses as well as gains. Past performance does not guarantee future results.

You acknowledge that:

  • you may lose some or all of your capital;

  • market conditions can change suddenly;

  • broker execution, spreads, slippage, latency, downtime, and account type can affect results;

  • and no result is guaranteed.

11. Your Responsibilities

You are responsible for:

  • ensuring your broker, account type, and MT5 setup are compatible with the software;

  • maintaining a stable internet connection and VPS if required;

  • monitoring your account and settings;

  • understanding the product before using it on a live account;

  • and complying with the rules of your broker and local laws.

We are not responsible for errors caused by incorrect setup, unsupported account types, broker restrictions, or user modifications.

12. Support

We may provide technical support at our discretion or according to the plan you purchased. Support may include:

  • installation guidance,

  • licence activation assistance,

  • general troubleshooting,

  • and basic usage questions.

Support does not include:

  • managing your trades,

  • guaranteeing profits,

  • fixing broker-side problems,

  • or making trading decisions for you.

13. WhatsApp and Email Communication

By providing your email address or phone number, you consent to receive service-related communications such as:

  • account notices,

  • licence information,

  • subscription updates,

  • support messages,

  • and important service announcements.

If you opt in to a WhatsApp group or community, you agree to receive related messages and understand you may leave the group at any time, subject to group rules.

14. Prohibited Use

You may not use our Services to:

  • violate any law or regulation;

  • commit fraud or misrepresentation;

  • distribute malware, spam, or harmful code;

  • infringe intellectual property rights;

  • attempt unauthorized access to our systems;

  • share licence access with unauthorized users;

  • or abuse support channels.

We reserve the right to investigate suspicious activity and take appropriate action.

15. Intellectual Property

All content, branding, design, text, software, graphics, logos, product names, and related materials associated with WeThinkTrades are owned by us or licensed to us and are protected by applicable intellectual property laws.

You may not use our intellectual property without prior written consent.

16. Service Availability

We aim to provide reliable access, but we do not guarantee uninterrupted or error-free operation. Temporary downtime may occur due to:

  • maintenance,

  • server issues,

  • payment processor interruptions,

  • third-party service failures,

  • or circumstances beyond our control.

We are not liable for losses caused by temporary unavailability.

17. Termination and Suspension

We may suspend or terminate your access immediately if:

  • you violate these Terms;

  • payment fails or is reversed;

  • we detect fraud or misuse;

  • or we believe your use of the Services creates legal, technical, or security risk.

Upon termination, your licence or subscription rights may end immediately, and you may lose access to the product or dashboard.

18. Disclaimer of Warranties

Our Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including:

  • merchantability,

  • fitness for a particular purpose,

  • non-infringement,

  • and uninterrupted availability.

We do not guarantee that our software will be profitable, error-free, or compatible with every broker or system.

19. Limitation of Liability

To the fullest extent permitted by law, WeThinkTrades and its owners, employees, contractors, and affiliates shall not be liable for:

  • trading losses,

  • lost profits,

  • missed opportunities,

  • data loss,

  • downtime,

  • broker issues,

  • VPS issues,

  • payment disputes,

  • or indirect, incidental, special, or consequential damages.

If liability is found despite this limitation, our total liability will not exceed the amount you paid for the specific Service giving rise to the claim.

20. Indemnity

You agree to indemnify and hold harmless WeThinkTrades from any claims, losses, damages, liabilities, costs, and expenses arising from:

  • your use of the Services;

  • your breach of these Terms;

  • your violation of law;

  • or your misuse of our software or website.

21. Privacy

Your use of our Services is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal information.

22. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on our website with a revised effective date. Continued use of the Services after changes means you accept the revised Terms.
